Personal data processed and the purposes of processing
Data you submit through the contact and request forms on our site is processed only to provide the service:
- Identity and contact data (full name, phone, email): responding to your request, appointments/scheduling and providing information
- Request content (your message, your service request, the details you provide): fulfilling the request and quotation processes
- Transaction security data (IP address, date/time, technical log records): security, prevention of misuse and legal obligations
Legal basis and method of collection
Your data is collected electronically through web forms, phone, email and WhatsApp, on the legal grounds set out in Article 5(2) of the KVKK: "being directly related to the establishment or performance of a contract" and "the legitimate interest of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject".
Commercial electronic messages (campaigns/announcements) are sent to you only on the basis of the separate express consent you give under Law No. 6563; you may withdraw this consent at any time.
Transfers and processing abroad
Your personal data is not sold or transferred to third parties for marketing purposes. Your data is shared only (a) with competent authorities and institutions where required by a legal obligation and (b) with our infrastructure/hosting service provider to the extent strictly necessary to provide the service, and in each case is limited to what is necessary.
Because of the infrastructure service that hosts our site, your data is processed in data centers located in Europe. This counts as a transfer abroad under Article 9 of the KVKK, and the transfer is carried out on the basis of the safeguards provided for by law (a written undertaking/standard contract, together with technical and administrative measures).
Retention periods
At the end of the retention period, your data is erased, destroyed or anonymized.
- Form and request records: up to 2 years
- Records arising from a contract or invoicing relationship: for the periods set out in the applicable legislation
- Transaction security/log records: for the period set out in the applicable legislation
Your rights under Article 11 of the KVKK
- To learn whether your data is processed and to request information about it
- To learn the purpose of processing and whether your data is used in line with that purpose
- To know the third parties to whom your data is transferred, domestically or abroad
- To request correction if your data has been processed incompletely or inaccurately
- To request erasure or destruction of your data within the framework of Article 7 of the KVKK
- To request that any correction/erasure be notified to the third parties to whom the data has been transferred
- To object to an outcome against you that results from analysis by automated systems
- To claim compensation if you suffer damage because of unlawful processing
Application procedure
You can submit requests regarding your rights, in line with the Communiqué on the Procedures and Principles of Application to the Data Controller, by email to info@nezaf.com or in writing to the postal address above. Applications are concluded free of charge within 30 days at the latest; if the action involves an additional cost, a fee may be charged according to the tariff set by the Personal Data Protection Board.
